Andrew Essam is a Chartered Quantity Surveyor, qualifying in 1986, and has been a Construction Adjudicator since 2001 having over 30 years experience in the construction industry.
Having worked as a QS in a professional practice, as a QS on the construction side and having worked on behalf of clients, design professionals, contractors, sub-contractors and suppliers Andrew has a comprehensive understanding of the challenges facing all parties in the construction industry supply chain.
He is on various Adjudication Panels and has been nominated by the ConstructionAdjudicators.com, CIC, CIArb, AICA and RICS and through party appointments to act as an Adjudicator on over 200 Construction Adjudications.
These adjudication appointments have included consideration of legal issues such as formation of and interpretation of contract, express and implied terms; fundamental and repudiatory breach of contract, termination, damages for breach of contract, liquidated damages, unliquidated damages, penalties, claims for payment, rates for payment, disruption claims, global claims, quantum meruit, set-off and counter claims, causation, delay, concurrency, extensions of time, reasonable period of time, time at large; practical completion, non-completion, delayed completion; agents authority, ostensible authority, instructions for additional or varied work, defective work; mistake, waiver, estoppel and economic duress.
He is experienced in dealing with adjudications between all parties within the construction industry supply chain from Main Contractor, Sub-Contractor, Sub-Sub-Contractor, Employers or Clients of all type to Consultants. These have arisen on a vast array of building, civil and process engineering projects under various contracts, including the various standard JCT, NEC, PPC contracts with or without amendments, oral contracts and bespoke contracts with the value in dispute ranging from thousands to multi million pounds.
Andrew has acted as a Party Representative in connection with various construction disputes he has been involved in the preparation of adjudications for Payment Notices, Extension of Time and Loss and Expense Claims, Valuations and Final Accounts. He acts for clients in numerous specialist areas of the construction industry including Groundworks, Structural Steelwork and Architectural Metalwork, Curtain Walling, Cladding, Masonry, Partitions, Suspended Ceilings, Flooring, Water and Process Engineering.
